Terms and Conditions: Digital Pass, between the user and Tafelmusik. Please read these terms, along with our Ticket Policy found here.

Terms of Use: The Digital Pass is a service that offers access to digital concerts and musical performances, as well as pre-concert chats and other events. This content is accessed online through a Vimeo showcase, with a direct link and password provided by Tafelmusik. Access to the showcase requires an internet connection; the cost of this connection remains entirely at the user’s expense.

In order to stream digital content with your Digital Pass, you will need to use a personal computer, tablet, or other device that meets the system and compatibility requirements required for enjoying digital concerts.  Our concerts are supported through most computers and up to date browsers.

Your ability to watch concerts on your television depends on your individual hardware: Tafelmusik recommends connecting to television with HDMI when possible, though casting over WIFI, from one smart device to another, is possible.

We reserve the right to make changes to our video delivery software which may effect compatibility for some devices and software. Devices that are compatible at one time may cease to be compatible in the future.

The Digital Pass allows you to access digital content for one year (access specified during your purchase). In advance of the end of this period, you will be invited to renew your Digital Pass.

User: The person who purchased the Digital Pass

1. The Service

The Digital Pass is a service that offers digital concerts and musical performances, and other digital content.

The Service is accessed through a showcase on a 3rd party streaming platform (Vimeo). In order to access this showcase, the User must purchase the Digital Pass, and provide a valid email address in order to receive customer service communications and online access information, including direct link and password.

Access to Services also requires an internet connection; the cost of this connection remains entirely at the user’s expense.

2. Compatible Devices

In order to stream Digital Content with your Digital Pass, you will need to use a personal computer, tablet, or other device that meets the system and compatibility requirements that we establish from time to time (a “Compatible Device”).  These requirements are subject to change. In some cases, whether a device is (or remains) a Compatible Device may depend on software or systems provided or maintained by the device manufacturer or other third parties.

3. Geographic Variability

If you are located or access Digital Content from an area outside of the Eastern Standard time zone, the dates and times of your access may vary. All scheduled dates and times are in Eastern Standard Time unless otherwise indicated.

4. Digital Content

a. The Digital Pass may allow you to access Digital Content for viewing during a limited period of time.

The Digital Pass is currently available as an annual pass. The Digital Pass, the extent of available Digital Content, and the specific titles available through the service, may change without notice. Unless otherwise indicated, any price changes are effective as of the beginning of the next Digital Pass period.

Please note you will have access to the current season’s content as it premieres starting September 1 and ending August 31.

b. Pricing

The pricing for the Digital Pass includes HST and service charges.

c. Cancellation of Digital Pass

All sales are final. Payment is processed upon receipt of order, after which there are no cancellations or refunds.

d. Billing and Payment Methods

Payment for the Digital Pass is paid as a one time fee. The Digital Pass is purchasable online or over the phone through the Tafelmusik Box Office. Accepted payment methods are: Visa and Mastercard.

If we are unable to process your payment using your designated payment method, we reserve the right to charge any payment method we have on file for you. If payment is not received within 30 days of initiation date, the Pass and all associated benefits will be cancelled.

e. Limited License to Digital Content

 Subject to payment of any charges to purchase, or access Digital Content, and your compliance with all terms of this Agreement, Tafelmusik grants you a non-exclusive, non-transferable, non-sub licensable, limited license, during the applicable Viewing Period, to access and view the Digital Content in accordance with the Usage Rules, for personal, non-commercial, private use.

f. Playback Quality; Streaming

The playback resolution and quality of the Digital Content you receive will depend on a number of factors, including the type of Compatible Device on which you are accessing the Digital Content and your bandwidth, which may increase or decrease over the course of your viewing. While we strive to provide you a high quality viewing experience, we make no guarantee as to the resolution or quality of the Digital Content you will receive when streaming.

g. General Restrictions   You may not (i) transfer, copy or display the Digital Content, except as permitted in this Agreement; (ii) sell, rent, lease, distribute, or broadcast any right to the Digital Content; (iii) remove any proprietary notices or labels on the Digital Content; (iv) attempt to disable, bypass, modify, defeat, or otherwise circumvent any digital rights management or other content protection system used as part of the Service; or (v) use the Service or Digital Content for any commercial or illegal purpose.

5. Software

The Service and Software may provide Tafelmusik with information relating to your use and the performance of the Service and Software, as well as information regarding the devices on which you stream and use the Service and Software. For example, the Software may provide Tafelmusik with information related to the Digital Content that you stream and your use of that Digital Content (such as whether and when you viewed the Digital Content, which may, among other things, help us measure the Viewing Period for Rental Digital Content).

6. Additional Items

a. Termination

 We may terminate your access to the Service, including anycontent available as part of the Service, at our discretion without notice (except as may be required by applicable law). If we do so, we will give you a pro-rated refund of your Digital Pass fee; however, if you violate any of the terms of this Agreement, your rights under this Agreement will automatically terminate without notice, and Tafelmusik may, in its discretion, immediately revoke your access to the Service and to Digital Content without refund of any fees.

b. Communications

By purchasing a Digital Pass from Tafelmusik, you electronically agree to accept and receive communications from Tafelmusik including email and calls. If you do not wish to receive promotional emails or other communications you may opt-out by clicking the unsubscribe button in one of our emails. Please note you may continue to receive emails regarding your direct purchase including but not limited to receipts, concert access and customer service announcements.

 c. Modification of Service

Tafelmusik reserves the right to modify, suspend, or discontinue the Service, or any part of the Service, at any time and without notice (except as required by applicable law), and Tafelmusik will not be liable to you should it exercise such rights, even if your ability to use Digital Content is impacted by the change.

d. Amendments

Tafelmusik reserves the right to make changes to this Agreement at any time in connection with the Service. To the maximum extent permitted by law, your continued use of the Service following any changes will constitute your acceptance of such changes. However, any increase in fees will not apply until your Digital Pass is renewed.

e. Reservation of Rights; Waiver

The Service and the Digital Content embody intellectual property that is protected by law. Copyright owners of Digital Content are intended third-party beneficiaries under the Agreement.

 f. Severability

If any term or condition of this Agreement is deemed invalid, void, or for any reason unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining term or condition.
